The NSW government recently introduced comprehensive reforms to fire safety regulations. These changes, which took effect as part of the Environmental Planning and Assessment (Development Certification and Fire Safety) Amendment Regulation 2023, aim to enhance compliance and ensure safer buildings across the state.
What’s Changing?
1️⃣ Construction Certificates: New requirements standardise how the Building Code of Australia (BCA) editions apply to certificates. This ensures consistent application of building standards across projects.
2️⃣ Inspection Powers: Regulators can now conduct inspections at any stage of construction for buildings under the Home Building Act, including residential and multi-story buildings. Non-compliance can result in stop-work orders or rectification directives.
3️⃣ Accountability Measures: Anti-phoenixing laws target builders or directors who attempt to avoid liabilities through insolvency, preventing them from continuing harmful practices in the industry.
